Frequently Asked Questions

What is NHAI NOC and when is it required for properties along National Highways?

NHAI NOC (No Objection Certificate) is required when any property, petrol pump, or utility service needs access to or crosses the Right of Way (ROW) of a National Highway. Approval from NHAI is mandatory before constructing an entry or exit road, petrol pump access, or laying utilities such as telecom cables, water pipelines, gas pipelines, or sewer lines along or across a National Highway.

Is NHAI permission required for access from private property to a National Highway?

Yes. Any entry or exit connection from private property to a National Highway requires approval from NHAI as per the guidelines issued by the Ministry of Road Transport and Highways (MoRTH). Constructing access without approval may result in penalties or removal of the unauthorized access.

How long does it take to obtain NHAI NOC approval?

The time required for NHAI NOC approval varies depending on the case, documentation, and technical review by the concerned NHAI authority. The process generally includes proposal submission, document verification, technical examination and approval through the official NHAI/MoRTH portal.

What documents are generally required for an NHAI NOC application?

Typical documents required for an NHAI NOC application include a location map, site plan, property ownership documents, highway access drawings, utility layout drawings, and other supporting documents as required for submission on the official NHAI/MoRTH portal.

Can NHAI NOC be obtained for petrol pumps or retail outlets on National Highways?

Yes. Petrol pumps or retail outlets located along National Highways require NHAI approval for highway access permission. The proposed access design must comply with MoRTH guidelines regarding safety, spacing, and traffic movement.

What is the difference between Provisional NOC and Final NOC from NHAI?

A Provisional NOC is issued after approval of the proposal and drawings. The applicant is generally given one year to complete construction of the approved access or utility work. After completion of construction as per the approved drawings, the applicant can apply for Final NOC.

What if construction cannot be completed within the time given in Provisional NOC?

If construction cannot be completed within the given time, the applicant may apply for Extension of Time (EOT). Generally, EOT can be granted a maximum of two times, with one year extension each time, subject to approval by NHAI. A genuine reason for the delay in construction must be provided while applying for the extension.

Can rejected or pending NHAI NOC applications be corrected and resubmitted?

Yes. Applications that have been returned for correction, rejected, or kept pending due to technical queries can be reviewed and resubmitted with corrected drawings and proper documentation through the NHAI/MoRTH portal.
